Family Bible Ministries may, but is not obligated to, monitor or review any areas on the Site where users transmit or post Communications or communicate solely with each other, including but not limited to chat rooms, bulletin boards or other user forums, and the content of any such Communications. Family Bible Ministries, however, will have no liability related to the content of any such Communications, whether or not arising under the laws of copyright, libel, privacy, obscenity, or otherwise.

Any linked sites are not under the control of Family Bible Ministries and Family Bible Ministries is not responsible for the content of any linked site or any link contained in a linked site. Family Bible Ministries reserves the right to terminate any link or linking program at any time. Family Bible Ministries does not endorse companies or products to which it links and reserves the right to note as such on its web pages. If you decide to access any of the third party sites linked to the Site, you do this entirely at your own risk.

Applicable Laws

The Site is controlled by Family Bible Ministries from its offices within the state of West Virginia in the United States of America. Family Bible Ministries makes no representation that Materials in the Site are appropriate or available for use in other locations, and access to them from territories where their content is illegal is prohibited. Those who choose to access the Site from other locations do so on their own initiative and are responsible for compliance with applicable local laws. You may not use or export the Materials in violation of U.S. export laws and regulations. Any claim relating to the Materials shall be governed by the internal substantive laws of the State of West Virginia. Sole and exclusive jurisdiction for any action or proceeding arising out of or related to this agreement shall be an appropriate state or federal court located in the state of West Virginia.

West Virginia Code 46A-6G imposes “Limitations on unauthorized electronic mail: ... No person may initiate the transmission of an unauthorized electronic mail message … or a bulk electronic mail message from a computer located in the state of West Virginia or to an electronic mail address that the sender knows, or has reason to know, is held by a West Virginia resident … a minimum damage assessment of one thousand dollars may be recovered for violations of this article. Punitive damages may be awarded for the willful failure to cease initiating unauthorized bulk electronic mail messages. Court costs and reasonable attorney fees may be awarded for violations of this article.”

Ohio Revised Code 2307.63 (Passed by the Ohio Senate, pending House approval): “If a person transmits or causes to be transmitted an electronic mail advertisement in violation of division (B) of this section, the recipient of the electronic mail advertisement may bring a civil action against that person to enforce that division. The recipient may recover both of the following in the civil action: (1) Actual damages or damages of one hundred dollars per electronic mail advertisement received in violation of division (B) of this section, whichever is greater; (2) Reasonable attorney's fees, court costs, and other costs of bringing the action.”
